Privilege of Confidentiality
Several times, it is observed that supervisors start speculation about the problems of the employees. The supervisor while referring the employee to the Employee Assistance Programs needs to refrain from uttering anything that cannot be repeated by the Employee Assistance Programs contact person in the court of law. Most commonly, the contract between the Employee Assistance Programs and employer states that supervisors referrals are confidential, but supervisor in not an Employee Assistance Programs client and hence, the privilege is not guaranteed. There is a possibility of disclosure, if there is any compulsion by law. The distinction between confidentiality and privilege also applies in certain situations created by employees. For instance, if an employee discloses personal problems to the Employee Assistance Programs agent, it is not privileged to legal discovery irrespective of contract agreeing to provide complete confidentiality. It is suggested to hire only licensed professionals, while selecting Employee Assistance Programs providers.
